1. The DBUY CARS website (Site) is intended to advertise and provide information related to motor vehicles. It is developed by INFO TECH WEB DIGITAL AGENCY LTDA (INFO TECH WEB), responsible for its installation and maintenance. The term "Site" for the purposes of these "Terms and Conditions for Use of the Site" ("Terms of Use") encompasses all and any pages of the "Site" available for access.

All intellectual property rights (including copyright) related to the DBUY CARS website belong to INFO TECH WEB, including but not limited to: (i) any software, application, or functionality used to maintain the operation of the DBUY CARS website, (ii) the visual identity of the "Site", especially the graphic design of any of its pages, (iii) the databases included therein and their compilation, (iv) any content created and produced by INFO TECH WEB, by itself or by third parties hired by it.
3. By accessing the Site, the "User", whether a natural person or a legal entity, agrees to all conditions set forth in the "Terms of Use", taking sole responsibility for all actions performed on or related to the "Site".

Access to the "Site" is regulated by these "Terms of Use", applying to any person accessing the "Site", referred to as "User", including but not limited to those who: (i) post any vehicle advertisements through the "Site", specifically referred to as "User/Advertiser", encompassing both natural persons (private individuals) and legal entities (dealers), (ii) use any other services offered on the "Site" for any purpose, including to negotiate with duly registered advertisers, this "User" specifically referred to as "User/Buyer (Visitor)".
5. The "User/Advertiser" may access the Site to post vehicle advertisements and view its content for any purpose.
6. The "User/Advertiser" is prohibited from: (i) submitting to the "Site" any content (including information, advertisements, texts, or photographs): (a) in corrupted or virus-infected files that may harm the "Site" or any duly registered "User/Advertiser", (b) that is erotic, pornographic, obscene, defamatory, or libelous, or that promotes crime, drug use, alcohol consumption, smoking products, physical or moral violence, or that violates ethical standards, morals, or good customs, (c) that promotes or incites prejudice (including origin, race, sex, color, and age) or any form of discrimination, as well as hate or illegal activities, (d) that infringes any legal provisions or third-party rights, including intellectual property and personality rights, such as copyrights, industrial property rights, trade secrets, privacy rights, etc., or (e) that contains incorrect, untrue, confidential, or proprietary information, or other information that may mislead any other User, (ii) using the "Site" or its available services for purposes other than those intended, (iii) using data from any duly registered advertisers on the "Site" for purposes other than making a proposal for the purchase of the advertised vehicle or requesting more information about the advertisements contained therein, (iv) submitting information owned by third parties, including to manipulate or disguise the origin of any content sent to the "Site", or to assume the identity of another person, (v) performing any actions that, directly or indirectly, may harm the "Site", any "User" or third parties.
7. The "User/Advertiser" who posts a vehicle advertisement on the "Site" must provide their registration data and information about the advertised vehicle, as well as the registration data of the respective owner.
8. The "User/Advertiser" acknowledges that: (i) any photographs submitted to the "Site" must not contain: images of natural persons, especially children; images of identifiable commercial establishments, stores, or buildings; images that reproduce intellectual works, trademarks, or distinctive signs owned by third parties, (ii) submitting any photograph and information about the advertised vehicle and its respective owner to the "Site" grants authorization to the "Site" to disclose it on the "Site" and, at its sole discretion, on any other websites and channels for searching and/or comparing motor vehicle offers by their respective users. The "Site" may perform any actions related to the photograph, including its storage on a computer, inclusion in a database, editing, compression, or any other adaptation necessary for the mentioned disclosure. This authorization will be valid and effective in Brazil and abroad for the entire period of the respective advertisement.
9. The "User/Advertiser" declares they hold the proprietary copyright over any photograph submitted to the "Site" or are authorized by the rightful owner to grant the authorization mentioned in the "Terms of Use", being solely and fully responsible for any and all damages caused to the "Site", INFO TECH WEB, any "Users", or any third parties due to non-compliance with the provisions of this item.
10. If the "User/Advertiser" submits any photograph that violates any provision of these "Terms of Use", the "Site" reserves the right not to disclose it or to remove it at any time and at its sole discretion, informing the user if deemed necessary.
11. The "User/Advertiser" who posts a vehicle advertisement on the "Site" declares they are aware and agree that advertisements not in compliance with these "Terms of Use" or any other document included may be removed from the "Site" at any time and at the sole discretion of the "Site".
12. The trademarks included on the "Site" may not be used by any "User" in any way or form.
13. The "User" must use the "Site" only for its intended purposes, not being able to reproduce, distribute, transmit, disclose, alter, or use, in any way or form, the "Site" or any content inserted therein, including photographs submitted by advertisers. Reproduction, distribution, transmission, disclosure, alteration, or any other use, in any way or form, of the "Site" or any content inserted therein by third parties, including for disclosure on other websites, physical media, or other means, will not be the responsibility of the "Site".
14. The "User" DECLARES that: (i) when negotiating with other "Users" of the "Site" or third parties, they do so at their own risk, (ii) they hold or are authorized to use all and any rights related to the respective contents submitted for disclosure on the "Site", including photographs of motor vehicles, and that these contents do not violate the provisions of these "Terms of Use" or any legal provision, (iii) they are solely and exclusively responsible for the information contained in their respective advertisements, the advertised products, the negotiations and transactions they conduct with other "Users" of the "Site", and the registration information provided and contained on the "Site", (iv) they will be solely and fully responsible for any and all damages, direct and/or indirect, caused to the "Site", INFO TECH WEB, or third parties due to any act or fact committed within the scope of the "Site", including with regard to the respective advertisement and negotiations and transactions conducted with other "Users" of the "Site", (v) the "Site" and "INFO TECH WEB" do not provide business intermediation services, the "Site" being only a means for displaying vehicle advertisements, where the parties, visitors, buyers, and sellers, do not have any commercial link with the "Site" or INFO TECH WEB, (vi) they are aware that the publication of the advertisement is not a guarantee of a completed negotiation between buyers, sellers, and interested parties.
15. The "User" is AWARE that the "Site" and INFO TECH WEB: (i) do not grant warranties for hidden or apparent defects in the negotiated products, (ii) do not guarantee the accuracy and/or veracity of the information contained in the advertisements, which may contain inaccurate, incorrect, and/or substantial or typographical errors, (iii) are not owners of the advertised products, therefore, not responsible for them, and likewise, are not intermediaries of the conducted business.
16. The "User" ACCEPTS and EXCLUDES the "Site" and INFO TECH WEB from liability: (i) for the existence, quantity, quality, condition, integrity, or legitimacy of the products offered, acquired, or alienated by the "Users", as well as for their capacity to contract or the veracity of the personal data they provide in their registrations, (ii) for the effective fulfillment of the obligations assumed by the "Users", including potential buyers, (iii) for the advertisements posted on the "Site", (iv) for the delivery of products advertised on the "Site", even if the negotiation was initiated through it.
17. The "Site" may contain links to third-party sites that are not owned or used by INFO TECH WEB, and therefore, INFO TECH WEB is not responsible for the information and content disclosed therein or for inactive URLs.
18. The "Site" does not guarantee that the content and materials inserted, used, and disclosed on the "Site" will be up-to-date or fully complete and is not responsible for any errors, failures, inability to access the Site, interruptions, defects, delays in operation or transmission of the Site, or failure of the line or system used to access the Site.
19. These "Terms of Use", as well as the information, materials, and means used to enable the interaction of "Users" with the "Site", may be changed in whole or in part at any time and at the sole discretion of INFO TECH WEB.
